We are noticing an atypical delay in the adjudication of DACA renewal requests. The USCIS website continues to strongly encourage applicants to apply for renewal 120-150 days prior to their expiry date, and their approximate wait times still say 4 months. However, nationwide reports indicate that these processing times are not accurate. As of May 2026, applicants from November of 2025 are still awaiting a decision.
We do not currently have a predictable wait-time estimate for DACA renewal applications. A May 8 Policy Memo indicates that all applications for Deferred Action are to be carefully reviewed, which may lead to unpredictable wait times. We have previously recommended that clients apply for renewal in USCIS’s recommended window. There is no harm in filing early, but there is also no guarantee that filing earlier than recommended will cause your application to be reviewed more quickly.
At this time, we recommend that you contact your attorney to discuss whether filing your DACA renewal application earlier than the recommended 120-150 days prior to expiration is right for you and your case.
