$100,000 H-1B Fee in Effect While Litigation Pending

Although a U.S. Court overturned the $100,000 H-1B fee (which applies to new H-1B petitions filed for consular processing), the court allowed the fee to remain in effect while the government’s appeal is pending. As of today (July 14, 2026), the fee is still in effect.
