Fiscal Year 2023 H-1B Cap Lottery: Updates

March 29, 2022 marked the closing date for the initial selection of H-1B lottery registrants in the fiscal year 2023 lottery. U.S. Citizenship and Immigration Services (USCIS) selected 85,000 registrations, to meet this year’s cap. Each registrant selected in the initial round has been notified.

If you registered in this year’s lottery, but you (or your foreign workers) have not yet been selected, do not lose hope! Since the implementation of the new registration system, USCIS has conducted additional selections. Last year (fiscal year 2022), USCIS conducted two additional selections: on July 28, 2021 and November 19, 2021.

You do not need to do anything in order to be considered for any additional selections that USCIS may conduct. Your unselected registration is automatically considered in future selections. Registrants selected in this initial round must send in their applications by June 30, 2022. Therefore, we expect to see a second selection period around the same time as last year—in late July or early August.

If you or your foreign workers have not yet been chosen in the lottery, and you have concerns about work authorization gaps, you can schedule a consultation with Binsfeld Law Firm by calling 612-339-0033, to discuss alternative options while you wait for final selections.
